Is it necessary to apply for a building permit or a declaration of work? This is the question everyone asks when he starts work at home. You are told everything you need to know before launching an extension project, to avoid disappointments and unnecessary costs.

The declaration of work or building permit are essential and mandatory steps if you wish to undertake work in your home. Whatever your project, before you even look at a plan, go to the town hall of your home. This is the essential step to know the entire legal framework: you will know what it is possible to do or not and what papers to fill. Otherwise, your dream is likely to end in ruins.

Declaration of work or building permit?

The prior declaration is required in three cases:

1. For extension work or changes of destination of an existing building, if the floor area or the created footprint is less than 20 m2. This limit increases to 40 m2 in urban areas covered by a local urban plan (PLU) or by a specific land use plan. Finally, since March 27, 2014, if the municipality depends on a PLU, you no longer have to respect the coefficient of land use (COS) which imposed a minimum size of land to enlarge.

2. When the total area or footprint of the building does not exceed 170 m2, after work.

3. For work modifying the exterior appearance of the building. For all other cases, it will be necessary to go to the building permit.

Time limits for the declaration of work and the building permit

- One month for the prior declaration. -

- Three months for building permit applications.

These delays can be extended in some cases: historic building, classified area, etc.

Procedures after the instruction period

- The works are accepted: you have two years to start them. Beyond, the authorization is no longer valid.-

- The works are refused: you can ask the town hall to review its decision by stating your reasons by registered letter, with acknowledgment of receipt. In case of failure, you have two months to seize the administrative court.

- No answer: if the instruction time has elapsed, rejoice. This is a tacit non-opposition to the realization of the project.

The steps to be taken at the end of the work

Consider sending the completed Declaration of Completion form to your property tax office. It will be used to calculate the property tax and the housing tax.

Glossary of technical terms of the declaration of work and the building permit

Floor area : sum of the enclosed and covered areas under a ceiling height of 1.80 m, calculated from the inside of the facades, after deduction of attics, cellars, etc.

Footprint : vertical projection of the volume of the house on the ground. We take into account here the walls, except garage.
